Paid Events Host Agreement

Popameeting and Pomsoft are the merchant of record for ticket sales processed through the service. Attendees pay Pomsoft; you do not receive direct card payouts through Stripe Connect unless we separately agree in writing. You authorize us to collect, hold, and apply ticket proceeds in our discretion.

Paid checkout is optional and enabled only when we invite your account. We may revoke access at any time, with or without cause. Revocation does not entitle you to damages or continued use of payment features.

You are solely responsible for your event, accuracy of listings, compliance with law, taxes, permits, insurance, safety, and attendee communications. You will not use paid checkout for prohibited goods, services, gambling, investment schemes, hate, harassment, or unlawful activity.

We may deduct platform fees, payment processing fees, chargeback costs, and other amounts from gross ticket revenue. We may change fee schedules and pricing rules with reasonable notice when practical. Continued use after changes constitutes acceptance. We may set or enforce price floors, ceilings, or currency restrictions.

Refund and cancellation policies displayed on your event are subordinate to this agreement and our operational rules. We may issue full or partial refunds, deny refunds, or resolve chargebacks in our sole discretion. You agree to cooperate with investigations and accept our decisions as final for platform purposes. Host-initiated refunds through the product do not limit our rights.

We may delay, withhold, or offset amounts for risk review, event non-performance, suspected fraud, legal process, or chargebacks. No interest accrues on held funds unless required by law.

You will defend, indemnify, and hold harmless Pomsoft and its affiliates from claims arising from your events, your content, your attendees, tax obligations, injuries, regulatory violations, or breach of this agreement.

PAID CHECKOUT IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, POMSOFT DISCLAIMS ALL WARRANTIES. POMSOFT'S TOTAL LIABILITY ARISING FROM PAID CHECKOUT SHALL NOT EXCEED THE GREATER OF (A) FEES WE RETAINED FROM YOUR EVENTS IN THE THREE MONTHS BEFORE THE CLAIM OR (B) USD $100.

This agreement is governed by the laws applicable to Pomsoft's principal place of business, without regard to conflict rules. Disputes shall be resolved in the courts or venues we designate, unless mandatory law provides otherwise.
